When Is DWI Charged as a Felony?

In Texas, the following offenses may be classified as felony DWI charges:

  • NIntoxication Assault – Causing a car accident that results in serious bodily injury to another person, while DWI. Defined in Texas Penal Code § 49.07, penalties may include a fine of up to $10,000 and up to 10 years in prison.
  • NDWI with Child Passenger – DWI with a passenger who is less than 15 years old in the vehicle at the time of the offense. Defined in Texas Penal Code § 49.045, penalties may include imprisonment for up to 2 years and a fine of $10,000
  • NIntoxication Manslaughter – Causing a fatal auto accident while DWI. Under Texas Penal Code § 49.08, penalties for intoxication manslaughter may include a fine of up to $10,000 and 2-20 years in state prison.
